Legal Notice
The Department of Financial Services is required to provide you the following notice pursuant to New York Insurance Law § 5109(a). Section 5109(a) requires the Superintendent of Financial Services (“Superintendent”), in consultation with the Commissioner of Health and the Commissioner of Education, to promulgate standards and procedures for investigating and suspending or removing the authorization for health service providers to demand or request payment for health services under Article 51 of the Insurance Law (the “no-fault insurance law”) upon findings of certain unlawful conduct reached after investigation, notice, and a hearing. On March 9, 2012, the Superintendent promulgated a regulation, 11 NYCRR 65-5, that sets forth such standards and procedures, the provisions of which take effect on June 12, 2012.
